Terms of Use

Effective October 8, 2026

These terms are an agreement between you and VCA Design, operating as DiveSphere (“DiveSphere”, “we”) for your use of divesphere.app. By creating an account or using DiveSphere you agree to them, and to our Privacy Policy.

Not a safety or dive-planning tool

Diving is dangerous. Dive site details, conditions, weather, tides, calculators and other divers’ logs on DiveSphere are shared for information only. They may be incomplete, out of date or wrong. Never rely on DiveSphere to plan or conduct a dive: dive within your training and certification, use your own dive computer and tables, check local conditions and regulations yourself, and follow your agency’s and dive operator’s procedures.

Your account

  • You must be at least 16 to use DiveSphere. If you’re under 19, a parent or guardian must agree to these terms for you.
  • Keep the Google or Facebook account you sign in with secure; you’re responsible for activity on your account.
  • You can delete your account at any time in account settings.

Your content

You own the dives, notes, photos, messages and other content you add. You give us a non-exclusive, worldwide, royalty-free licence to store, display and process that content as needed to run DiveSphere and to show it to the people your visibility settings allow. Dive sites you add, and photos used on them, stay available to the community after you delete your account, without your name.

You confirm you have the right to share what you post, including photos.

Community rules

  • Be respectful. No harassment, threats, hate or spam.
  • Don’t post other people’s personal information without their permission.
  • Keep site information honest; don’t knowingly post false conditions or hazards.
  • Don’t try to break, scrape or overload the service, or access other accounts.

We may remove content or suspend accounts that break these rules. You can report content or block another diver at any time.

Events

DiveSphere lists events, such as meet-up dives, trips, courses and cleanups, organised by its members, clubs and businesses. We don’t organise, supervise or vet them. An event being listed, with or without a host badge, isn’t an endorsement of the event or of whoever runs it.

Organisers are responsible for what they run, including its safety, any permits or insurance it needs, and who they accept. Every diver dives within their own training and certification, uses their own judgement, and decides for themselves whether an event and its conditions are right for them. DiveSphere isn’t a party to any arrangement between organisers and attendees, including payments.

Connected services

If you connect a service such as Suunto, its own terms also apply, and we access it only to import your dives. You can disconnect it at any time.

Changes and availability

DiveSphere is provided “as is”. We may change, pause or discontinue features. If we change these terms in a way that matters, we’ll tell you before the change takes effect.

Liability

To the extent the law allows, DiveSphere is provided without warranties of any kind, express or implied, including that it will be accurate, available or free of errors.

To the extent the law allows, we aren’t liable for any indirect, incidental, special or consequential loss, or for any injury, loss or damage arising from a dive, an event or any other activity you plan or take part in using information on DiveSphere. Our total liability to you for any claim about DiveSphere is limited to the greater of the amount you paid us in the 12 months before the claim and CAD $100.

Nothing in these terms limits rights you have under British Columbia consumer protection law that can’t be limited by agreement.

Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. If you have a concern, contact us first and we’ll try to resolve it. Claims within the small claims limit of the Civil Resolution Tribunal (currently $5,000) may be brought there; any other claim must be brought in the courts of British Columbia sitting in Vancouver.
